Terms of Service

These Terms of Service ("Terms") govern the use of the CustomerAI platform, provided by CustomerAI LLC, a New York Domestic Limited Liability Company ("CustomerAI," "we," or "us"), by businesses that subscribe to the Service ("Clients") and by individuals who interact with a Client's AI assistant ("End Users").

1. What CustomerAI Provides

CustomerAI provides an AI-powered assistant that answers phone calls, text messages, and website chat inquiries on behalf of a Client's business ("the Service"), using business information the Client provides.

You are interacting with an artificial intelligence system. When you contact a business using CustomerAI, your call, text, or chat is initially handled by an AI assistant, not a human employee. You may request to speak with a person at any time, and the assistant is designed to transfer certain situations (such as emergencies or complaints) to a human automatically.

2. Client Subscriptions and Payment

Access to the Service is provided on a subscription basis, billed monthly in advance. Payment is processed through Stripe, a third-party payment processor. CustomerAI does not directly collect, store, or have access to your full payment card details. All payment data is handled by Stripe in accordance with Stripe's own security standards and Privacy Policy.

Subscriptions may be canceled at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time within a billing period unless required by law.

3. Client Responsibilities

Clients are responsible for the accuracy of the business information (hours, pricing, policies, etc.) they provide to the Service, and for promptly updating it when it changes. Inaccurate information provided by a Client may result in the AI assistant relaying inaccurate information to End Users.

4. Limitations of the Service

The Service uses an AI language model and may occasionally produce inaccurate, incomplete, or unexpected responses. The Service is not a substitute for direct human judgment in urgent, safety-related, or legally sensitive situations. Clients remain responsible for how they staff and supervise emergency response for their own business.

5. Data and Privacy

Use of the Service, including handling of End User data, is also governed by our Privacy Policy.

6. Termination

Either party may terminate a subscription as described in Section 2. CustomerAI may suspend or terminate access to the Service for violation of these Terms.

7. Limitation of Liability

To the maximum extent permitted by law, CustomerAI's liability arising from use of the Service is limited to the amount paid by the Client in the three (3) months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of New York.
